1. Eligibility

You must be at least 18 years of age to use our platform, submit an application, or participate in any collaboration or event managed by Influencers Night Media.

By using our services, you confirm that:

the information you provide is accurate, complete, and up to date;
you have the legal capacity and authority to enter into these Terms; and
you comply with all applicable laws and regulations.

Submitting an application does not guarantee approval or participation. All applications are reviewed solely at the discretion of Influencers Night Media in accordance with these Terms and our internal approval process.

2. About Influencers Night Media

Influencers Night Media is a standards-driven managed collaboration platform for the food and beverage industry.

We work with restaurants, cafés, lounges, bars, hotels, and other hospitality businesses by planning and managing organised influencer collaborations.

We are not an open influencer marketplace where anyone can register and connect directly with businesses.

We are not a talent agency, employment agency, advertising agency, public relations agency, or social media management company.

Our role is to establish professional standards, manage collaborations, coordinate campaigns, and maintain accountability between participating venues and influencers.

Approved users may also be required to comply with our Onboarding & Platform Guidelines, together with any role-specific terms applicable to influencers, venues, or customers.

3. Applications and Approval

Participation on our platform is strictly by approval only.

Influencers and venues may submit an application to work with us.

We reserve the absolute right to approve, reject, suspend, or remove any applicant or participant at our sole discretion, with or without providing any reason.

Submission of an application does not create any right to participate on the platform.

Approval to join the platform does not guarantee selection for any collaboration, campaign, event, or future opportunity.

4. Platform Profiles

Business profiles and influencer profiles are created and managed by Influencers Night Media.

Users may provide information, photographs, documents, social media links, and other materials for inclusion in their profiles.

We may edit, organise, update, or remove profile information to maintain consistency, accuracy, professionalism, and platform standards.

A verified profile does not represent an endorsement, guarantee, certification, or recommendation by Influencers Night Media.

Verification may be suspended or revoked at any time.

Users remain responsible for ensuring that all information submitted to us is accurate, lawful, and does not infringe the rights of any third party.

The collection, storage, and processing of profile information is governed by our Privacy Policy.

5. Nature of the Platform

Influencers Night Media is a managed collaboration platform that facilitates professional marketing collaborations between independent hospitality businesses and independent content creators.

Our services may include planning and managing influencer events, coordinating participants, facilitating communications, overseeing campaign deliverables, providing operational support, and administering approved partner programmes where applicable.

We are not a party to any independent commercial relationship or agreement entered into directly between users unless expressly stated in writing.

The final selection of influencers, venues, campaigns, collaborations, referral programmes, and affiliate participation remains entirely at our discretion.

Requests made by a venue for specific influencers, or by an influencer for specific venues, may be considered but are not binding on Influencers Night Media.

Where applicable, additional rights and obligations are governed by:

6. User Responsibilities

All users must:

provide accurate, complete, and up-to-date information;
communicate professionally and respectfully;
honour confirmed commitments;
comply with all applicable laws and regulations;
comply with these Terms and all applicable platform policies.

Users must not:

provide false or misleading information;
impersonate another person, business, or organisation;
engage in abusive, threatening, discriminatory, harassing, or unlawful behaviour;
submit fraudulent engagement, fake followers, fake social media metrics, or misleading analytics;
misuse the platform or interfere with its operation;
attempt to gain unauthorised access to any part of the platform or its systems.

All users are expected to comply with our Community Standards & Code of Conduct.

Failure to comply with these standards or any applicable platform policy may result in suspension or permanent removal from the platform.

7. Managed Collaborations

Influencers Night Media primarily operates through organised group collaborations involving multiple influencers.

Participation in any collaboration, campaign, or event is subject to confirmation by Influencers Night Media.

Once participation is confirmed, all parties are expected to fulfil their agreed responsibilities unless otherwise approved by us in writing.

Operational procedures, campaign requirements, participation standards, and onboarding requirements are further described in our Onboarding & Platform Guidelines.

Additional responsibilities applicable to influencers, venues, and customers are governed by their respective role-specific terms and conditions.

8. Payments

Unless otherwise agreed in writing, all fees payable by venues, customers, or other users shall be paid directly to Influencers Night Media.

Where applicable, Influencers Night Media may make payments, reimbursements, commissions, or other amounts to participating influencers, venues, or other eligible parties in accordance with the relevant agreement or programme.

All payment terms, invoices, due dates, cancellations, refunds, late payments, and related financial matters are governed by our Payment Cancellation & Refund Policy.

Participation in any affiliate or referral programme is governed separately by the applicable:

Where there is any inconsistency between these Terms and a specific Operating Agreement or Commission Schedule, the Operating Agreement or Commission Schedule shall prevail for that programme.

9. Intellectual Property

All trademarks, logos, branding, designs, graphics, website content, software, text, and other intellectual property owned or licensed by Influencers Night Media remain our exclusive property unless expressly stated otherwise.

Nothing contained in these Terms grants any user ownership of, or licence to use, our intellectual property except as necessary to access and use our platform in accordance with these Terms.

The ownership, permitted use, licensing, infringement, reporting procedures, and enforcement of intellectual property rights are governed by our Content & Intellectual Property Policy.

10. User Content

Users may submit photographs, videos, documents, social media links, campaign materials, testimonials, reviews, and other content in connection with our platform or services.

By submitting such content, you confirm that you own or have obtained all necessary rights, permissions, licences, and consents required to provide that content to Influencers Night Media.

Unless otherwise agreed in writing, you grant Influencers Night Media a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, edit, publish, distribute, display, promote, and otherwise use such content in connection with our platform, business operations, marketing, promotional activities, and related services.

Users remain solely responsible for all content submitted by them.

Further provisions relating to ownership, licensing, copyright, infringement, takedown requests, and content usage are governed by our Content & Intellectual Property Policy.

11. Suspension and Termination

Influencers Night Media may suspend, restrict, deactivate, or permanently remove any user, account, application, profile, venue, influencer, customer, or business from the platform at any time, with or without prior notice, where permitted by law.

Grounds for suspension or termination may include, but are not limited to:

breach of these Terms;
breach of any applicable platform policy;
breach of any role-specific terms or operating agreement;
fraudulent, misleading, abusive, or unlawful conduct;
conduct that may damage the reputation, security, integrity, or operation of the platform.

Removal from the platform does not affect any obligations, liabilities, or payment responsibilities that arose before the date of suspension or termination.

Users must continue to comply with any surviving obligations contained in these Terms or any other applicable agreement.

12. No Exclusivity

Unless expressly agreed otherwise in writing, participation on our platform is entirely non-exclusive.

Influencers remain free to work with other agencies, brands, venues, businesses, or platforms.

Venues remain free to engage with other marketing providers, agencies, or influencer platforms.

Nothing in these Terms creates an exclusive relationship between Influencers Night Media and any user.

13. No Guarantees

While Influencers Night Media aims to deliver professionally managed collaborations and marketing services, we do not guarantee any specific commercial or marketing outcome.

Without limitation, we do not guarantee:

sales;
revenue;
customer footfall;
reservations;
event attendance;
bookings;
social media growth;
engagement rates;
viral content;
media coverage;
search rankings;
business success; or
influencer performance beyond their agreed obligations.

Marketing results depend upon numerous factors beyond our reasonable control, including consumer behaviour, market conditions, venue operations, platform algorithms, competition, and the actions of third parties.

14. Third-Party Services

Our website and services may reference, integrate with, or rely upon third-party platforms, products, software, payment providers, ticketing systems, analytics tools, communication services, mapping services, social media platforms, or other external services.

Influencers Night Media does not own or control such third-party services and is not responsible for their availability, security, accuracy, policies, functionality, or performance.

Your use of any third-party service is governed solely by the terms and policies of that third party.

Influencers Night Media shall not be liable for any loss, damage, delay, interruption, or dispute arising from the use of third-party services.

15. Disclaimer

Our website, platform, and services are provided on an “as available” and “as is” basis.

While we strive to provide professional, reliable, and well-managed services, we do not represent or warrant that our platform, website, collaborations, events, campaigns, communications, or related services will always be uninterrupted, error-free, secure, accurate, or suitable for every user’s objectives.

Nothing contained on our platform constitutes professional legal, financial, tax, business, marketing, or investment advice.

Additional exclusions, limitations, assumptions, and important notices relating to our services are set out in our Disclaimer, which forms part of these Terms.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Influencers Night Media, its owner, directors, employees, contractors, affiliates, representatives, and partners shall not be liable for any indirect, incidental, consequential, exemplary, special, punitive, or business losses arising from or relating to:

the use of, or inability to use, our platform or services;
participation in any collaboration, campaign, programme, or event;
acts or omissions of any venue, influencer, customer, guest, or third party;
third-party platforms or services;
user-generated content;
delays, cancellations, technical failures, or circumstances beyond our reasonable control.

To the fullest extent permitted by law, our total aggregate liability arising from any single claim shall not exceed the total amount actually paid directly to Influencers Night Media for the specific service, campaign, collaboration, programme, or event giving rise to that claim.

Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by applicable law.

17. Indemnity

You agree to indemnify, defend, and hold harmless Influencers Night Media, its owner, directors, employees, contractors, representatives, affiliates, successors, and assigns from and against any claims, demands, actions, proceedings, damages, liabilities, losses, costs, penalties, and expenses (including reasonable legal fees) arising directly or indirectly from:

your breach of these Terms;
your breach of any applicable platform policy;
your breach of any role-specific agreement;
your unlawful, negligent, fraudulent, or misleading conduct;
your violation of any third-party rights;
any content, materials, information, or data submitted by you;
your participation in any collaboration, campaign, affiliate programme, referral programme, or event.

This indemnity survives the suspension, termination, or expiration of your relationship with Influencers Night Media.

18. Privacy

Our collection, storage, processing, disclosure, and use of personal information are governed by ourPrivacy Policy.

Where applicable, cookies, analytics technologies, and similar tracking tools may also be used in accordance with our Privacy Policy.

By accessing or using our website or services, you acknowledge that you have read and understood our Privacy Policy.

19. Changes

Influencers Night Media reserves the right to modify, update, replace, suspend, or discontinue these Terms, our website, platform, services, programmes, policies, or any related document at any time.

Updated versions become effective upon publication unless otherwise stated.

Your continued use of our platform after any changes become effective constitutes your acceptance of the revised Terms.

20. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India.

The parties agree to first attempt to resolve any dispute, claim, or disagreement through good-faith discussions.

If a dispute cannot be resolved amicably, it shall be referred to arbitration in Delhi in accordance with the applicable laws of India.

Subject to applicable law, the courts located in Delhi shall have exclusive jurisdiction over any matter not resolved through arbitration or where judicial intervention is permitted.
